Sa pinakahuling desisyon ng Energy Regulatory Commission (ERC), napatunayan na nagkaroon at nagsagawa ng sobrang singil sa kuryente ang Ibaan Electric Engineering Corporation (IEEC) mula sa mamamayan ng bayan ng Ibaan ng kabuuang halaga na P31,313,600.14. Ang nasabing desisyon ay nakapaloob sa ERC Case No. 2014 – 066 CF kung saan ang desisyon ay isinagawa noong December 10, 2015.
Pag-aari ng Metro Rei Business Park at pinamamahalaan ni Bb. Joy Salvame bilang Board Secretary, nauna ng nag-sumite ng application sa ERC ang Ibaan Electric ng under-recovery na nagkakahalaga ng P19,879,756.95 noong October 13, 2014. Sinasabi dito na ganitong halaga ang kanilang kakulangan kung kayat hinihiling nila sa ERC na payagan sila na masingil ang nasabing halaga mula sa kanilang kunsomidores sa bayan ng Ibaan.
Matapos maisumite ng Ibaan Electric ang mga dokumento na kinakailangan, nagkaroon ng “Pre-Trial Brief” noong October 20, 2014. Sinundan ito ng paglabas ang ERC ng Order And Notice Of Public Hearing noong October 23, 2014 na isinagawa noong November 25, 2014.
Isang araw bago ang itinakdang Public Hearing, November 25, nagsumite naman si Mayor Danny Toreja bilang kinatawang ng Municipality of Ibaan ng Motion For Leave To Intervene kung saan hiniling niya sa ERC na tingnan kung makatarungan ang halagang P19,879,756.95 na hinihiling ng Ibaan Electric na masingil mula sa mamamayan ng Ibaan.
Sa masusing pag-aaral at pagsusuri ng ERC, lumalabas na sobra pa ang nagawa nilang pagsingil sa halaga ng kuryente. Ayon pa sa ERC, over-recovery ang ginawa ng Ibaan Electric na mayroong kabuuan halaga na P31,313,600.41.
Ayon pa sa ERC, ilan sa kanilang naging obserbasyon sa aplikasyon ng Ibaan Electric ay ang mga sumusunod (mula sa Page 9 of 15 ng nasabing desisyon na itinakda sa ERC Case No. 2014 – 066 CF):
“Moreover, the Commission observed the following during the evaluation of IEEC’s application:
a. For the year 2011, the IEEC ERRONEOUSLY encoded previous two (2) months lag in its kWh sales, instead of current kWh sales;
b. The encoded Generation Rate (GR) in the model/simulation by the IEEC in support of the application is INCONSISTENT WITH THE ACTUAL IMPLEMENTED GR AS REFLECTED IN IEEC’s CONSUMER BILLS. These inconsistencies in the IEEC’s model/simulation REDUCED THE REVENUE AND EVENTUALLY RESULTED IN IEEC’s ALLEGED UNDER-RECOVERY in the generation cost;
c. The encoded System Loss Rate (SLR) in the model/simulation by the IEEC in support of its application IS LIKEWISE INCOSISTENT WITH THE ACTUAL IMPLEMENTED SLR AS REFLECTED IN THE IEEC’s SUBMITTED CONSUMER BILLS. The inconsistencies in the IEEC’s model/simulation REDUCED THE REVENUE AND EVENTUALLY RESULTED IN IEEC’s ALLEGED UNDER-RECOVERY in the system loss;
d. The actual implemented GR and SLR as reflected in the monthly consumer bills are higher than the supposedly computed monthly GR and SLR using the formula provided in Article 2 of the Rules Governing The Automatic Cost Adjustment and True-Up Mechanism and Corresponding Confirmation Process for Distribution Utilities; and
e. The IEEC collected additional Franchise Benefits to Host Communities (FBHC) amounting to PhP0.0245/kWh NOTWITHSTANDING THE ABSENCE OF SUPPORTING DOCUMENT to show that such rate was charged separately by TLI.
Ayon pa sa ERC, taliwas sa aplikasyon ng Ibaan Electric na nagkaroon sila ng under-recovery na nagkakahalaga ng P19.8M, ipinakikita ng kanilang mga isinumiteng dokumento na over-recovery na nagkakahalaga ng P31.3M ang kanilang isinagawa (Page 12 of 15).
It is worthy to note that IEEC stated in its appication that it had incurred a net under-recovery of P19,879,756.95. However, a careful scrutiny and evaluation of the records and submissions of the IEEC revealed that the purported net under-recovery was in fact a net over-recovery amounting to PhP (31,313,600.41) as shown here in below:
Dahil dito, inutusan ang Ibaan Electric na mag-refund ng nasabing halaga. Iniuutos din ng desisyon na agad na ipatupad at isagawa ang pagre-refund sa susunod na “billing cycle” mula sa pagtanggap ng kopya ng desisyon (Page 13 o 15).
Accordingly, the IEEC is hereby directed to REFUND the following amounts starting the next billing cycle from receipt hereof until such time that the full amount shall have been fully refunded:
a. GENERATION COST (over-recoveries) amounting to Twenty Two Million Fifty Five Thousand Eight Hundred Forty-Nine and 03/100 (PhP22,055,849.03), equivalent to PhP(0.2898)/kWh to be refunded to its consumers;
b. TRANSMISSION COST total (over)-recoveries amounting to Six Million Three Hundred Forty Two Thousand Three Hundred Fifty-Two and 34/100 Pesos (PhP6,342,352.34);
c. SYSTEM LOSS (over)-recoveries amounting to One Million Two Hundred One Thousand Six Hundred Eighty-Seven and 52/100 Pesos (P1,201,687.52), equivalent to PhP(0.0158)/kWh to be refunded to its customers;
d. LIFELINE (over)-recoveries amounting to One Million Seven Hundred Nine Thousand Ninety-One and 96/100 Pesos (PhP1,709,091.96), equivalent to PhP(0.0235)/kWh to be refunded to its non-lifeline customers; and
3. SENIOR CITIZEN SUBSIDY over-recoveries amounting to Four Thousand Six Hundred Nineteen and 55/100 Pesos (PhP4,619.55), to be refunded to its subsidizing customers.
In connection therwith, the IEEC s hereby directed to comply with the following:
a. SUBMIT, within ten (10) days from its initial implementation a sworn statement indicating its compliance with the aforesaid directive;
b. REFLECT the net (over)/under recoveries in the monthly computations of GR, TR, SLR, LSR and SrSR as “OGA” for Generation, “OTCA” for transmission, “OSLA” for System Loss; “OLRA” for Lifeline Subsidy; and “OSrRA” for Senior Citizen Subsidy; and
c. ACCOMPLISH and SUBMIT a report in accordance with the attached prescribed format, on or before the 30th day of the following moth, together with the monthly reportorial requirement, and every month thereafter until the amount shall have been fully refunded/collected.
Finally, THE IEEC IS DIRECTED TO COMPLY STRICTLY WITH THE FOREGOING AND IMMEDIATELY IMPLEMENTED THE SAME IN THE NEXT BILLING CYCLE upon receipt there hereof.
