     IBAAN MUNICIPAL PHYSICAL FITNESS AND SPORTS DEVELOPMENT COUNCIL

 

PREAMBLE

We, the officers and members of the Ibaan Municipal Physical Fitness and Sports Development Council, imploring the aid of divine providence, in order to organize and establish a strong and dedicated Sports body which shall provide the mechanics needed to foster self-discipline, sportsmanship, leadership, teamwork and excellence for the development of a healthy, alert and responsive citizenry who are committed to the spirit of nationalism and patriotism through the establishment and creation of this sports policy making body, do ordain and promulgate this constitution and by-laws.

 

ARTICLE I

OBJECTIVES

 

To carry out the policies of the State in the promotion and development of sports through the aid of a body corporate known as the Ibaan Municipal Physical Fitness and Sports Development Council.

 

 

ARTICLE II

PLACE OF BUSINESS

 

The principal place of business of the Ibaan Municipal Physical Fitness and Sports Development Council shall be located and established at Barangay Poblacion, Ibaan, Batangas.

 

ARTICLE III

BOARD OF DIRECTORS

 

The power and functions of the Ibaan Municipal Physical Fitness and Sports Development Council shall be exercised and its business and operations conducted and all its properties and or equipments shall be controlled by the board of directors, who shall be appointed by the Municipal Mayor who shall act as Chairman of the said council from a list of nominees submitted to him by each of the accredited and existing sports clubs/ associations of which each of the said association must be represented in the board of directors. They shall hold office for 3 years or until their successors are duly appointed. Re-appointment is allowed.

 

ARTICLE IV

VACANCY

Any vacancy in the board of directors shall be filled up by appointing a new director from a list of the sports clubs/ associations concerned. The appointee shall hold office for the unexpired term of the predecessor.

 

ARTICLE V

QUORUM

 

A majority of the board of directors shall be necessary at all meetings to constitute a quorum for the transaction of any businesses and every decision of majority of the directors duly assembled as a board shall be valid as a council’s act.

 

ARTICLE VI

 MEETINGS

            a. Meet at least once a month and plan and formulate a blue-print for the short, medium and long term for sectoral sports based on the National policy and Program of “Sports for All”, including a well- synchronized year round calendar of sports activities and competitors culminating in national “Palarong Pambansa.

 

The special meetings may be called by the Chairman of the board or upon a written request of any director addressed to the board. Written notice of all the meetings of the board of directors specifying the dates, time, place and objects or reasons of such special meeting shall be given at least 5 days before the scheduled meeting.

 

ARTICLE VII

GENERAL POWERS

 

The board of directors shall have entire charge of all the equipments, business and general operations of the Ibaan Municipal Physical Fitness and Sports Development Council with respect to its annual programs and activities, with full power and authority to manage and conduct the same. The board of directors shall also have general powers and supervision over all sports clubs/associations affiliated to it. Likewise, the board of directors shall exercise the following functions. To wit:

1. To formulate and plan a municipality-wide integrated sports development program.

2. Prepare a year-round physical fitness and sports development program for the barangays of the Municipality of Ibaan in coordination with other municipal offices/agencies.

3. Coordinate all sports activities and physical fitness programs of the various offices/agencies of the municipality of Ibaan as well as supervise the improvement and construction of sports facilities/playground in line with the objective of promoting physical fitness and sports consciousness among citizens, specially the youth sector.

4. Coordinate with governmental and private agencies such as the Department of Education (DepEd), Philippine Sports Commission (PSC), And National Sports Association (NSA) in the organization and conduct of mass-based sports projects/activities in the municipality.

5. Perform such other function as may be assigned by the Chairman.

ARTICLE VIII

SPORTS CLUBS/ASSOCIATIONS

 

The following shall be the recognized sports clubs/ association and shall be under the general power and supervision of the Ibaan Sports Development Council to wit:

 

A. Barangay Basketball Club                                J.  Chess

B. Barangay Volleyball Club                                 K. Boxing

C. Barangay Table tennis Club                             L.  Billiards

D. Barangay Badminton Club                               M. Darts

E. Karatedo Club                                                     N. Swimming

F. Tae Kwon Do Club                                             O. Arnis

G. Soccer Club                                                         P. Sepak Arnis

H. Baseball Club

I. Bikers Club

 

And such other club that may be created or  organized pursuant to the by-laws of the Ibaan Municipal Physical Fitness and Sports Development Council when such necessities arises, the different sports club /association referred to in the preceding paragraph shall be governed by these constitution and by-laws. Each sports club/ association shall upon payment of their membership fees shall automatically be accredited by the Council. The amount of fees shall be determined by the board of directors.

 

ARTICLE IX

MINUTES

 

The minutes of all meetings of the board of directors of the Ibaan Municipal Physical Fitness and Sports Development Council shall be kept and carefully preserved as records of the business transacted.

 

ARTICLE X

OFFICERS

 

The officers of the Ibaan Municipal Physical Fitness and Sports Development Council shall consist of the following:

 

A. Chairman-The Chairman of the Ibaan Municipal Physical Fitness and Sports Development Council shall be the Municipal Mayor of Ibaan.

 

B. Vice-Chairman- The Chief of Police of the Municipality of Ibaan shall act as Vice-Chairman of the Ibaan Municipal Physical Fitness and Sports Development Council.

 

  1. President/Executive Director- To be appointed as such by the Chairman from among the members of the board of directors.

 

D. Secretary-General- To be appointed as such by the Chairman from among the members of the board of directors.

 

E. Director/Member- To be appointed by the Municipal Mayor from a list of nominees submitted to him by each of the accredited and existing sports clubs/ associations in the municipality who shall hold office for 3 years until their successors are duly appointed. Re-appointment is allowed.

 

F. Treasurer- To be elected by the majority vote of all the members of the board of directors from among themselves.

 

G. Auditor- To be elected by the majority vote of all members of the board of directors from among themselves.

 

H. PRO- To be elected by the majority vote of all the members of the board of directors from among themselves.

 

I. Ex-Oficio Directors:

 

1)    The SK Federation President, ABC President and Chairman of Youth And Sport  shall be an Ex-Oficio director of the Council.

2)    Representatives from the private and public schools in the municipality of Ibaan.

 

ARTICLE XI

CLUB OFFICERS

 

Each recognized and accredited sports clubs/ association by the Council shall have their own officers, to wit:

 

1. President

2. Vice-President

3. Secretary

4. Treasurer

5. Auditor

 

Said officers shall be elected by a majority vote of their respective sports clubs/ association members for 3 year. Re-election is allowed.

 

 

 

ARTICLE XII

QUALIFICATIONS

 

1} Directors-Must be a citizen of the Philippines, at least 18 years of age at the time of their appointment, with proven capacity for sports administration, and a person of good moral character who must be residing in Ibaan and a bonafide member of the accredited sports club/ association.

 

2} Club Officers- Must be a citizen of the Philippines and at least 18 years of age at the time of their election. A bonafide member of the sports club where he is elected and a person of good moral character and a resident of Ibaan.

 

 

 

 

 

ARTICLE XIII

ELECTION AND VACANCY

 

The officers shall be elected by the majority of all the members of their respective sports club for a term of 3 year. Re-election is allowed. Every vacancy shall be filled up by the majority vote of all the members of their respective sports club/ association for the unexpired term of the predecessor.

 

ARTICLE XIV

DUTIES AND RESPONSIBILITIES

 

1. Chairman- shall be the Chief Executive Officer of the Council. He shall preside over the meeting of the board of directors and call the orders of the day. He shall see to it that all orders and resolutions of the board are carried into effect. The Chairman shall require every head of each accredited sports club/association to submit to the board a monthly report regarding the operations and priority programs of their respective clubs as well as suggestions regarding such, including problems which confront their club/ association. The Chairman shall likewise keep a monthly report regarding the operations, proposals and or projects or programs of the Council and such other matters within his knowledge which the interest of the Council may require to be brought to the council’s attention. He shall likewise appoint or designate members of the board of directors of the Ibaan Municipal Physical Fitness and Sports Development Council. Likewise, he is empowered to appoint the different Committee Chairpersons and such other positions which the board may create.

 

2. Vice-Chairman-Shall attend all the meetings of the council and in the absence of the Chairman, shall preside over the meeting of the council. He shall likewise keep a monthly report regarding the operations, proposals and or projects or programs of the Council and such other matters within his knowledge which the interest of the Council may require to be brought to the council’s attention. Likewise, He may be required by the board to perform additional tasks which may be deemed necessary to best facilitate the objectives of the council.

 

3. President/Executive Director- Shall be appointed as such by the Chairman from among the members of the board of directors who shall direct and supervise the day to day operations of the Council. He shall likewise have supervision and control overall the officers of the various sports club as well as the various support services which are indispensable and necessary under the Ibaan Municipal Physical Fitness and Sports Development Council. The President/Executive Director shall submit a monthly report regarding the operations, proposals and or projects or programs of the various sports clubs/ associations which are duly accredited by the council to the Chairman. He/she shall likewise assure that all orders and resolutions duly adopted by the council are carried into effect. He/ She shall manage the day to day operations of the council.

 

4. Secretary-General- Shall keep the minutes of all meetings of the board of directors. To attend the meeting of the board of directors. To call the roll of members of the board. To read the calendar of business and the minutes of the previous meeting. To record and number all the resolutions passed by the board. To attest and affix the logo to all official act of the board. To notify the members of the board of directors of its regular and or special meeting. To perform such other duties as the board or the Chairman may require.

 

5. Treasurer- shall have charge of funds, securities, receipts and disbursements of the Ibaan Municipal Physical Fitness and Sports Development Council. He shall deposit or cause to be deposited all moneys and other valuable effects of the Council in such banks or trust companies as the board may designate. Render to the board wherever required an account of the financial condition of the Council and all other transactions made by him as treasurer. Keep correct books of account of all the business transacted by the Council by authority of the board, all checks paid out by the Council shall be signed by the treasurer and countersigned by the Chairman.

 

6. PRO- Responsible for the promotion and dissemination of information of the activities of the Council, as well as the proper documentation of all the activities of the Council in coordination with the board secretary.

 

7. Auditor-Audits all the cash inflows and outflows of the Council and furnish the board a written report of such.

 

8. Directors- Shall attend all the meetings of the board. Recommends or propose action plans pertaining to the annual sports development programs of the Council. Perform such other duties and responsibilities as Chairman or the board may assign. 

 

ARTICLE XV

FUNDINGS

 

To raise funds through appropriations of the municipal government of the Municipality of Ibaan, or by donations, sponsorships, benefits, membership fees, playing fees, bonds and other similar means.

 

ARTICLE XVI

MEMBERSHIP

 

All existing and accredited Sports Clubs/Associations, The Municipal Mayor as Chairman, SK Federation President, ABC President and Chairman of Youth and Sports  as Ex-Oficio Directors, and such other individuals or entities as the board of directors may accredit such as but not limited to a representative  from different local schools of Ibaan, both public and private.

 

ARTICLE XVII

BANK DEPOSITS

 

The Treasurer shall deposit the funds in the Council’s name as the same may come from his hands with such bank or banks as the board of directors may designate, unless otherwise determined by appropriate resolutions of the board of directors.           Withdrawal of funds deposited with any banking institution shall be made upon the signature of the treasurer and countersigned by the Chairman.

 

ARTICLE XVIII

LOGO

 

The logo of the Council, including the words to be inscribed shall be determined by the board of directors.

 

ARTICLE XIX

SUPERVISION AND CONTROL

 

The Chairman shall have direct and over-all supervision and control over the activities of the Council. He shall also appoint the members of the board of directors in the manner provided by the provisions of this by-laws. 

 

ARTICLE XX

AMENDMENTS

 

A majority of the members of the board of directors can pass or adopt an amendments.

ARTICLE XXI

BENEFITS

 

The Council through a resolution of the board shall have the power to provide such incentives, recognition and awards to deserving sports club, athletes, game officials, sports officials, coaches, trainers and other persons or entities involve in or supporting sports development programs/ activities. The board of directors shall set forth the criteria to be issued in the evaluation of such.

  

ARTICLE XXII

COMMITTEES

 

The board of directors shall create the necessary committees and vest them with authority to make investigations to ascertain facts; to make researches and recommendations to the Council or to transact other Corporate business such as the holding of sports clinics and seminars, trainings/tryouts for local as well as district and eventually national competitions or the likes and such other functions as the board of directors may designate. The following committees shall be:

 

1} Committee on Operation/Services:

-Which shall prepare an integrated sports development programs of the     municipality of Ibaan;

-Conduct, manage, and supervise the implementation of sports projects/activities            of the municipality of Ibaan;

-Coordinate with such other agencies, both public and private in the pursuit of a ttaining the objectives of the programs.

 

2} Committee on Training and Sports Development Services:

-Prepare a comprehensive annual training program for the entire municipality      which include but not limited to Sports Seminars and Clinics;

-Coordinate with other agencies, such as but not limited to the PSC, NSA, and    other sports clubs duly accredited by the council in the conduct of sports             seminars, trainings of athletes, local and aspiring game officials, coaches and          trainers.

 

3} Committee on Administrative Services:

-Shall be responsible in the supervision, maintenance and control of the Council’s office including but not limited to the athletic supplies and equipments;

-Be responsible in maintaining, updating and control of all the records and files of          the council and shall likewise act as records custodian of the Council;

-Shall act as liason with other agencies such as but not limited to the PSC, NSA,            and other sports clubs duly accredited by the council;

-Exercise administrative supervision over all the personnel of the Committee on Operation and the Committee on Administrative Services;

-Supervise data collection and information gathering intended for the preparation           of fiscal/budgetary requirements of the council.

 

Such other committees may be created by the board of directors in order to facilitate the conduct and operations of the Council. The Chairman and members of each committee shall be appointed by the board of directors from among the qualified members in the community or the municipality. The number of members of each committee is likewise left to the discretion of the Chairman of each respective committee. Additional functions of the foregoing committees may be prescribed/ determined by the board of directors should a need arise. 

ARTICLE XXIII

FUNCTIONS OF THE COUNCIL

The following are the functions of the Municipality of Ibaan Sports Development Council to wit:

1} To plan, implement and supervise an integrated amateur sports promotion and development program for the municipality;

2} Establish and maintain alliance with national sports associations and other non-governmental organizations whose main objective is sports;

 

3} Establish, develop and maintain fully equipped sports center in the municipality;

4} To encourage the youth sector  and other sports enthusiast to demonstrate self discipline and to foster nationalism and patriotism, accelerate social progress, and promote total human liberation, development and to sustain the establishment and organization of the Ibaan Municipal Physical Fitness and Sports Development Council, as well as its objectives in sports development programs of the municipality;

 

5} Conduct promotion and fund raising campaign in accordance with existing laws as well as to conduct basic and applied research on sports development to achieve its purpose. 

 

ARTICLE XXIV

DUTIES AND RESPONSIBILITIES OF SPORTS CLUB OFFICERS

The duties and responsibilities of sports club officers duly accredited by the Ibaan Municipal Physical Fitness and Sports Development Council shall be the following, to wit:

 

1} President– Shall be the head of their respective sports club; He shall supervise the conduct and operation of their respective sports club such as their training or practice; They shall coordinate with the Council regarding the status of their club and or make suggestions, recommendations, comments and the likes for the maintenance of a better sports relationships; Preside over their respective sports club meetings; attend or represents their respective sports club during a monthly consultative meeting with the Council and perform such other duties and functions as may be required by their club or as the council may require.

 

2} Vice-President– Shall assist the President in the discharge of his works and shall act as president when the former is incapacitated or the likes and shall perform such other function as the president may require or designate.

 

3} Secretary– Shall attend all the meetings of their respective club; Record the minutes of every meetings; Keep all the records and or other documents of their respective club; Call the roll of members in every meeting and shall submit before the board of directors or in the committee on membership the list of their official players and sports officials; and perform such other functions as the president or their club may designate. Shall be appointed by the President from among the members of the club.

 

4} Auditor– audits the cash inflows and outflows of their respective club; Submit before the board of directors an audited reports of their respective clubs when required by such; and perform such other functions as the president or their club may require. Shall be elected by the majority votes of all the members of the club.

 

5} Treasurer– shall keep the funds of their respective club; Shall be responsible for the payment of their membership dues, playing fees, bonds or other monetary requirements to the Council in behalf of their respective organization; Shall be elected by the majority vote of all the members of their respective clubs. He shall sign every checks and or deposits made in behalf of their respective clubs and such shall be countersigned by the president of their respective clubs.

 

6} Representatives from every team– Each sports team should be represented by at least one representative in the officers roll of their respective sports club. Such representative shall be chosen by a majority vote of all the team players of their respective sports clubs.
